About personal data

An individual’s access to their health records is covered by the Data Protection Act (as a subject access request), so no personal information of this sort will be published through the Freedom of Information Act. The Data Protection Act 1998 allows you to find out what information we may hold about you on computer and in certain paper records.

A patient’s personal representative and any person who may have a claim arising out of the patient’s death can apply for a copy of the records under the Access to Health Records Act 1990.

Request for personal information under the Data Protection Act 1998

On receipt of the completed form Request for Personal Info we will locate the health records and approach the health care professionals concerned for authority to release.

Unless specifically requested, the pathology and blood reports will not be included with the copies. You can view the health records at the hospital or request a copy to be sent to you. Once we receive your request we will aim to respond within 40 days. If we exceed this time limit we will explain the reasons for our delay and estimate how long it will take to meet your request.

You can expect to pay the following for each health record:

  • Viewing electronic and/or paper copies which have been updated within the previous 40 days of the application - No charge
  • Viewing electronic and/or paper health records which have not been updated within the previous 40 days of the application - £10 charge
  • Copies of electronic health records only (on DVD) - £10 charge
  • Paper photocopies of paper health records only - Up to £50 charge
  • Paper photocopies of paper and electronic health records - Up to £50 charge

 

We will notify you by letter when the notes are ready. Once you receive your record, if you believe any information is inaccurate or incorrect, please inform us.

In the interests of security, we would ask that if possible, you call into the Royal Liverpool University Hospital to collect your notes, bringing some form of photographic ID such as a passport or driving licence.

We ask that you advise us the day before collection so that we can have the notes parcelled and ready.

If you choose to receive your health records by post they will be dispatched on receipt of copy of photographic ID.

Application for health records under Access to Health Records Act 1990

As this request is for copies of deceased patients records, we can only release copies of health records to the patient’s personal representative or any person who may have a claim arising out of the patient’s death. If you require help with this please contact the department.
